Sales Conditions

General Provisions

These conditions are valid exclusively between the company and the individual business:

Hereinafter referred to as the “COMPANY,” and any person, physical or legal, who makes online purchases on the website www.militariainroma.com, hereinafter referred to as the “CUSTOMER.”

These conditions may be subject to changes, and the publication date on the website corresponds to the date of their entry into force.

These conditions govern purchases made on the website www.militariainroma.com, in accordance with the provisions of Part III, Title III, Chapter I of the Consumer Code, Legislative Decree No. 206/2005, as amended by Legislative Decree No. 21/2014 and Legislative Decree 70/2003 concerning electronic commerce.

ARTICLE 1 – Subject of the Contract

Under these general sales conditions, the COMPANY sells and the CUSTOMER purchases remotely the tangible goods indicated and offered for sale on the website www.militariainroma.com. Due to the large number of products available, the main characteristics and prices of the products (including any additional costs) are clearly indicated directly on the website.
The product offers on the website www.militariainroma.com are intended for customers who are of legal age. If the CUSTOMER is under 18 years old, they must first obtain the consent of a parent or legal guardian to make a purchase on www.militariainroma.com. By placing an order through this website, the CUSTOMER guarantees they are over 18 years old and legally able to enter into binding contracts.

The contract is concluded exclusively via the internet, through the CUSTOMER’s access to the address www.militariainroma.com and the creation of a purchase order according to the procedure specified on the site.

By electronically submitting their order, the CUSTOMER declares to have read and accepted these general terms and conditions and agrees to comply with them in their relationship with the COMPANY.

In the order confirmation email, the CUSTOMER will receive the text of these general sales conditions, as required by Article 51, paragraph 1 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014.

ARTICLE 2 – Pre-contractual Information for the Consumer – Article 49 of Legislative Decree 206/2005

Before concluding the purchase contract, the CUSTOMER reviews the characteristics of the goods presented in the individual product sheets at the time of selection.

Before concluding the purchase contract, the CUSTOMER is informed about:

  • The delivery methods for the products, the conditions for exercising the right of withdrawal, the return procedures and time frames for purchased products, and the general sales conditions, through a reference to the relevant page on the website.
  • Information and images of each Product and its related price.
  • Payment methods available.
  • Relevant shipping and delivery costs.

The CUSTOMER can, at any time and certainly before concluding the contract, access information about the COMPANY, its geographical address, telephone number, fax, email address, which are also provided below:

ARTICLE 3 – Conclusion and Effectiveness of the Contract

The sale contract is considered concluded when the COMPANY sends an email confirming the order to the CUSTOMER. The email contains the CUSTOMER’s details and order number, the price of the purchased goods, shipping costs, and the delivery address to which the goods will be sent. It will also include a copy of these conditions.

The CUSTOMER is obligated to verify the accuracy of the personal data in the email and promptly communicate any necessary corrections to the COMPANY.

The CUSTOMER is prohibited from entering false, invented, or fictitious names in the online order process and subsequent communications. The COMPANY reserves the right to legally pursue any violations and abuse, in the interest of consumer protection.

By accepting these Sales Conditions, the CUSTOMER also exempts the COMPANY from any responsibility arising from the issuance of incorrect fiscal documents due to data provided by the CUSTOMER during the online order process, as the CUSTOMER is solely responsible for the correct input of this information.

The COMPANY commits to describing and presenting the items sold on the site as accurately as possible. However, there may be some errors, inaccuracies, or minor differences between the site and the actual product.

The COMPANY commits to delivering the goods within 30 days from the date the COMPANY sends the order confirmation email to the CUSTOMER.

ARTICLE 4 – Product Availability

Product availability refers to the actual availability when the CUSTOMER places the order. This availability should be considered purely indicative, as products may be sold to other customers before the order is confirmed, due to simultaneous access by multiple users.

Even after the COMPANY sends the order confirmation email, partial or total unavailability of the goods may occur. In this case, the order will be automatically amended by removing the unavailable product, and the CUSTOMER will be promptly informed by email.

If the CUSTOMER requests cancellation of the order, terminating the contract, the COMPANY will refund the amount paid within 14 days from the day the COMPANY is notified of the CUSTOMER’s decision to terminate the contract.

ARTICLE 5 – Prices

All sale prices of products listed on www.militariainroma.com are expressed in Euros and include VAT where applicable.

Shipping costs are not included in the purchase price but are indicated and calculated at the conclusion of the purchase process before payment is made.

The CUSTOMER accepts the COMPANY’s right to change its prices at any time. However, the goods will be invoiced based on the prices indicated on the site at the time the order is created and indicated in the confirmation email sent by the COMPANY to the CUSTOMER.

In the event of an error (computer, manual, technical, or of any other kind) that results in a substantial, unanticipated change in the public sale price, rendering it exorbitant or clearly absurd, the purchase order will be considered invalid and canceled, and the amount paid by the CUSTOMER will be refunded within 14 days from the cancellation date.

ARTICLE 6 – Payment Methods

The CUSTOMER can make the required payment by selecting one of the following methods:

  • Payment via PayPal or credit card: If the CUSTOMER intends to pay via credit card, they may use PayPal’s payment process, which ensures confidentiality of the provided data. For further information and legal agreements, the CUSTOMER is advised to consult the website www.paypal.com.
  • Payment via bank transfer: Bank payments can be made using the following details:

ARTICLE 7 – Product Delivery

Products will be delivered via express courier to the address provided by the CUSTOMER during the order process within a maximum of 30 days from the date the CUSTOMER receives the order confirmation email from the COMPANY.

If payment is made via bank transfer, the purchased goods will be shipped upon receipt of the payment, usually within two to five days after the transfer is made (timing varies depending on the bank used). To expedite the process, the payment receipt can be sent to: info@militariainroma.com.

If the delivery fails due to the recipient’s absence at the specified address, the courier will leave a notice and attempt delivery again. If the recipient is still absent, the goods will be returned to the sender.

For every order made on the website www.militariainroma.com, the COMPANY issues an invoice for the goods. The invoice, which will be sent with the goods, will contain the information provided by the CUSTOMER during the purchase process. Once the invoice is issued, no changes can be made to the data on it.

ARTICLE 8 – Right of Withdrawal

In accordance with applicable legal provisions, the CUSTOMER has the right to withdraw from the purchase without penalty and without stating the reason within 14 days from the date of receipt of the goods. In the case of multiple items purchased in a single order and delivered separately, the 14-day period begins from the date the last item is received.

The CUSTOMER may exercise the right of withdrawal by sending any clear statement of their decision to withdraw from the contract or alternatively, by sending the standard withdrawal form as provided in Annex I, Part B, Legislative Decree 21/2014 (not mandatory). In case of exercising the right of withdrawal, the CUSTOMER must return the goods within 14 days from the day they communicated their decision to withdraw from the contract.

The direct costs of returning the products are at the CUSTOMER’s expense.

The goods must be returned intact, in their original packaging, complete in all parts (including packaging and any documentation and accessories) and with the attached fiscal documentation.

Subject to verifying compliance with the above, the COMPANY will refund the amount for the returned products within a maximum of 14 days, including any shipping costs.

As per Article 56, paragraph 3 of Legislative Decree 206/2005, amended by Legislative Decree 21/2014, the COMPANY may suspend the refund until receipt of the goods or until the CUSTOMER provides proof of having returned the goods to the COMPANY.

The COMPANY will process the refund using the same payment method chosen by the CUSTOMER during the purchase. In the case of payment by bank transfer, the CUSTOMER wishing to exercise their right of withdrawal must provide the COMPANY with the required bank details (IBAN, SWIFT, BIC) for the refund.

ARTICLE 9 – Legal Warranty of Conformity

In the event the CUSTOMER receives non-conforming or defective products, they have the right to restoration of conformity at no cost, either by repair or replacement of the product. The CUSTOMER may exercise this right if the defect appears within two years from the delivery of the goods and reports the defect to the COMPANY within two months from discovery.

ARTICLE 10 – Liability

The COMPANY is not liable for any disruptions caused by force majeure or unforeseeable events, even if caused by malfunctions and disruptions in the internet network, when unable to fulfill the order within the timeframes set out in the contract.

ARTICLE 11 – Integrity

These General Sales Conditions consist of all the clauses that make them up. If one or more provisions of these General Sales Conditions are deemed invalid or declared so under the law, regulations, or a decision by a competent court, the other provisions will remain fully effective.

ARTICLE 12 – Applicable Law and Jurisdiction

These General Sales Conditions are governed by Italian law.

Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the Court of the CUSTOMER’s place of residence or domicile, if located within the country.

In any case, the CUSTOMER may voluntarily resort to the mediation procedures under Legislative Decree 28/2010 for resolving disputes arising from the interpretation and execution of these sales conditions.
